Good News for Brand Owners... and a Warning
With effect from 1 April 2017, the Chinese Trade Mark Office has cut its official filing fees by 50%. On the face of it, this is great news for brand owners… but bear in mind that China has allowed a proliferation of bad faith applications. For years, opportunistic brand ‘hijackers’ have snapped up rights in China from under the noses of the legitimate brand owners. Many owners have often been forced to pay significant sums to regain their rights, in the face of an unsympathetic registry.
A recent glimmer of light has seen a case where the legitimate brand owner has succeeded in overturning a bad faith application, but our strong advice remains to get an application in as soon as possible: prevention is far better (and much cheaper) than cure!
